Legal Question in Personal Injury in Georgia

broken arm

at a rest area in georgia, i was tripped by a small dog and fell, resulting in a fracture to my arm. is the state of georgia immune to litigation, as there was no seperate area for the dog that i saw. i live in n florida and was hurt in georgia.

How was the state of Georgia negligent? Was it their dog? Did a state employee let the dog loose? Most places, private and public, do not have confined areas for dogs (or, for that matter, any other object one may trip over). The person who is generally liable for the dog's actions is the dog's owner. Whether the owner was somehow negligent, or whether you could have avoided the dog and the accident by looking where you were going, are additional questions.

The State of Georgia is not immune from being sued, however it seems the blame lies with the dog owner. If you have their information, you should bring a claim against him/her.
