That's a pretty broad question with no supporting details to enable me to give a very helpful answer. If you have a serious personal injury you can be sure that the insurance company will not pay fair value without you hiring an aggressive, competent, experienced attorney who specializes in personal injury cases. Even then, it is likely to take time as some insurers systematically undervalue all cases, at least until trial. If you are merely talking about property damage, get 2 or 3 repair estimates from reputable shops, or if a good shop will work with the insurer's estimate you may go with that. If the car is totalled, get the retail value from nada.com, cross reference with Auto Trader and checking with used car sales managers, and insist on something very close to that. Bear in mind, however, that the insurer may cut off the car rental once they offer what they say is actual cash value. You may represent yourself in suing the person who caused the wreck for any amount up to $15,000 in Magistrate Court in the county where that person resides.

If you had property damage only, i.e., damage to your car, you can negotiate this yourself. However, before you talk to the insurance company, get an independent appraisal as to the damage. If you had any personal injury, you should consult with a local attorney. NOTE: I would advise you not to sign any thing without having a local attorney review the document.
