If an attorney is representing you on a contigency basis - are his incurred expenses within the contigency percentage or are his incurred expenses in addition to the contigency percentage

That depends on your fee contract, so read it carefully. Usually the expenses are in addition to the fees.

Hello - the answer to your question can be found in the contract you signed with your attorney when you retained them. Generally, incurred expenses are in addition to the contingency percentage.
