Legal Question in Personal Injury in Georgia

I was driving in the far right lane on a 5 lane road consisting of 2 lanes going east, a turning lane and two lanes going west. I went through a ligh,t and about 200 feet after that a car pulled out right in front of me, causeing me to swerved left. I hit the quarter panel of another car that was to my immediate left...because if I would have stayed straight I would have T-boned the driver that pulled out in front of me. I was given a citation for changeing lanes improperly..but the driver was also given a ticket for failure to yeild..

I later found out after I recieved my ticket and left the sence by order of the police officer that the driver that pulled out right in front of me was under the influence, and was sent to jail for DUI.

Shouldn't my ticket be thrown out for this reason...it's very important that I find out because the lady that I swerved and hit is sueing.

Don't fixate on getting the ticket overturned. Even if you could overturn the ticket, it doesn't mean that you are automatically off the hook on the lawsuit. Likewise, just because someone gets a traffic ticket doesn't mean that they are automatically at fault in a resulting accident.
