who do I file claim with

i was a passenger in car accident where the driver hit us and drove away,we had to chase the driver into a parking lot in which he was leaving the parking lot when we arrived,later we found out the driver had ins but did not have valid drivers lincense,he just purchase his car,it still had dealer tags, who is responsible for paying for the damages, it seem the ins company is trying to deny our claim. Do i file a personally injured for my lower back pain, sue with his ins or do I , sue the dealer for selling him a car without a valid license, or the ins company for insuring someone who does not have a valid lincense

Yoiu need to hire a lawyer IMMEDIATELY. Do not directly talk to the insurer or anyone else; that will possibly compromise your claim. The longer you wait, the less a lawyer may be able to do. It is also very important that you get medical care that is needed; gaps in treatment cause a problem with claims (this is not a time to tough it out).

A note: if he did not have a license, it is very likely that he does NOT have valid insurance. But these are things you need to have a lawyer investigate.

Glen: You need to determine if the driver of the offending auto had any liability insurance available for the car. It appears from your email that the insurer for the lot is denying coverage. Do you personally or does the owner of the car you were in have uninsured motorist coverage? That will be the key to the case.
