Legal Question in Personal Injury in Georgia

My grandson as involved in an automobile accident - driver of other vehicle was at fault. Our insurance, State Farm, paid his medical expenses because the other driver's insurance attorney told us that because the passenger in this person's car was hurt more seriously that all of the money available was given for her medical expenses. Our grandson had a concussion and his medical expenses were approximately $6000.00. Do we have any legal recourse to take against this insurance company?

You have already done the worst thing you could have done - talking to the other insurer. Never do that. Insurers love to lie to and take advantage of people who don't have lawyers, and even when they do offer money, they offer far less to people without lawyers.

STOP Talking to them immediately and see a lawyer (my office offers a free consultation in such cases).

The other insurance company has misled your grandson. Policy coverage is per person not per incident. By that I mean, if their policy is $25,000/50,000. They will cover each person involved in the accident up to $25k. The $50k just means that the total amount they would ever pay to all parties is $50k. So, if they hit a city bus, and 25 people were injured, the insurance company is only on the hook up to $50k.

In applying your facts, your grandson would have a right to recover up to $25,000.00 from the other insurance company. I would not expect any offer close to $25k, but they are still on the hook for a settlement or verdict.

It is important that the parent or legal guardian of your grandson obtain a lawyer as a settlement involving a minor may need to be approved by the Probate Court.
