Injured at National Chain Restaurant

I recently crushed the end of my finger at a restaurant due to a seat that was not properly fastened. The management did not charge our group for breakfast (not that I could eat) and offered to pay my medical bills. They informed me they fixed the seat after I left.

This has caused significant inconvenience as I injured my writing hand, am a computer consultant having difficulty typing with a splint, and have had to cancel my participation in a musical performance (hobby) due to the injury.

Am I entitled to more than restitution?

Well, in the first place, you might not even be entitled to restitution. You must first prove liability. If you can do this, then you might be able to recover damages beyond your special damages, i.e., your documentable medicals and lost wages. Loss of income and other "specials" are up to you to prove. Bottom line: you have a case, but getting much more than your documentable specials is doubtful. On the other hand, remember the McDonald's hot coffee case. Miracles can happen.
