Legal Question in Personal Injury in Georgia

Part-time employee

My friend got injuries at workplace. Someone spilled liquid on the floor and then she slipped and hit the floor very hard and got shoulder injuried. Several months later, she got another injury affect her lumbar section on the spine and also hernia by left heavy object. She works as a part-time job. Her lawyer told her that award will much lesser than full-time employee. Is this true? Because my view either part-time or full-time will be same if get injury by accident. What is your view on this situation

The amount of compensation an injured employee may received is based on the average weekly wage for the 13 week period prior to the date of the injury. To this average a percentage of 66 2/3% is applied, subject to a maximum of $425.00 per week. A part time employee, it stands to reason, will have a lower average weekly wage.

This is probably what your friend's attorney is talking about. On the other hand, there are other questions your friend should be asking, such as, is she engaged in any form of concurent, similar employment? This could make a difference.

While I am reluctant to dispute another attorney's opinion who is more familiar with the whole case than I, my initial reaction is that there is no difference between your friend's status. I would advise your friend to seek the opinion of another local attorney.
