Legal Question in Personal Injury in Georgia

I got re-ended on June 13th. The other party is denying it and I want to take them to small claims court over the damages. How do I go about doing this and is this something I can win? I know the other parties cell #, address, home phone, a detailed description of her, that she has a 4 year old son.

Assuming they have insurance, and assuming you have full coverage you have a better option - simply make an insurance claim. And, if you were injured, instead of filing a case, you should see a lawyer. Car accident cases, unless you only have very minor damage from an uninsured motorist and lack full coverage, are not cases to handle yourself. In other words, unless insurance pays and there are no injuries, you need counsel.

Based on your facts, this is likely a case you can win. That said, I think you should get assistance prosecuting your claim. if you are looking for repayment for your property damage to your vehicle you can submit a time-sensitive demand to the insurance company. Because insurers are swamped with lawyers and their responsibility to resolve claims are hidden in statutes, they may not treat your case with the same priority/urgency as a case submitted by a lawyer.
