How to Sue someone?

I need to know how I can sue someone if they do not live in my state? I live in GA. and he live in Calf. Someone Please help. Been trying to get a answer for 3 months.

I genreally agree with Mr. Field. However, if your claim arose from a transaction in Georgia, you may be able to sue in Georgia under the Long Arm Jurisdiction Statute. If it arose from an automobile collision in Georgia, you could sue in Georgia under the Nonresident Motororist Jurisdiction Act. That's as much as I can tell you without knowing the facts.

Much depends on the nature of your claim, the location where the claim arose, and the contacts the defendant may have with the state of Georgia. With this information, it could be determined if you have to go to California to litigate, or whether it is possible to sue the defendant in Georgia based on the relationship of the claim and the defendant to Georgia.

You will need to file the suit in the county of the defendant's residence, which is, obviously, somewhere in CA. If you know the defendant's residence address, you can call the clerk of court in that county and probably get them to mail you the forms. CAVEAT: If you file in CA, you subject yourself to the jurisdiction of that court and may be required to go there for depositions, court appearances, etc. If you would like to discuss, please free to give me a call.
