Legal Question in Real Estate Law in Georgia

Auto title

I used an ex's credit to purchase a car. I have possession of the car now and always have. I paid off the car and now my ex refuses to release title. I have several emails from her, third party witnesses and verbal confirmations from her the auto is mine and that she would release the title. She never did release title, first claiming she didn't have it and now blatantly stating that I need to pay her to release the title to me. When I refused and now that she's in a financial bind she wants me to pher to release the car to her. I intend to file a civil suit. What is the best way to file for the release of the title to me? As a gift or. a breach of contract or forfeiture?

Re: Auto title

You didn't say by what authority you used her credit. This is just one question that needs to be addressed. Since we are talking about a paid-off car that is surely worth thousands of dollars, you should at least consult with a local attorney who can review the whole situation.

Re: Auto title

On this limited information, it sounds like you need to seek title of the car based on equitable principles. You need to consult with an attorney.
