Legal Question in Real Estate Law in Georgia

Beneficial Company

Our account number was change, and was not notified prior, there was no sell to another company. Received three different payoff within a month, after finding out our house was in foreclosure from the newspaper. When call an ask was told our house wasn't in foreclosure. This guy came by to buy the house and he showed me on the internet also that my house was in foreclosure. So he had a contract with him and ask did I want to sell this house and being frustrated and sick of getting the runnung around with beneficial that I signed the contract, and he said we had to get the payoff from the company so put do what was on the computer as the seeling price. The payoff came back six thousand more, now he pressure me to close on the house to bring six thousand that I donot have and he's telling me he have a signed contract and the house is his and we must close now. I explain to him and showed him proof of my payment and the account number being change. Don't know what to do next, Is the contract binding? Do I have to close if I don't have the money?

Re: Beneficial Company

When you sign a contract, you should assume you are bound by the terms. What you agree to sell it for, and the payoff of your loan, are two seperate issues. Contracts should not be signed unless they are fully understood. No one can guess whether the contract is valid or invalid for other reasons, but agreeing to sell for a low price is generally not grounds to get out of it.
