Legal Question in Real Estate Law in Georgia

Easement Agreement?

Are stormwater easements things that are legal agreements between a county and resident, or are they dictated by the county? Also, how legal is it for one to be moved onto my property due to the house next to me being developed?

Also looking for an experienced Georgia real estate lawyer (Atlanta area).

In most places, they are closer to being dictated by the county. There is an easement along most roads, and the county (or other local government) can do such things as adding storm inlets, drains, etc. With respect to your question about one being moved, it is impossible to answer on the facts stated, although it is certainly possible that it is within their rights to move it to another location in the easement.
