Legal Question in Real Estate Law in Georgia

We have been living in our home in Marietta for about three years now. When we first moved in we saw that after it rained the water would stand on our driveway, but it always dried up eventually, so we never though much of it. However in the last 6 months, the water has been continuous and it has caused the driveway to crack nonstop. There are even little "potholes" scattered around. We have called the company which provides our water, the county water department, the sewer department, but they all refuse to do anything because they say it is groundwater. But after some investigating we found that are neighbor's rain gutters face directly toward our driveway and we are pretty sure that is the major contributor to our problem. Their house is much higher than ours and the water runs down the hill and directly onto our driveway. We will talk to him and ask him to divert the water onto the street, but if he refuses do we have any basis to sue? This problem is causing us unbelievable stress because little by little the whole house could just disintegrate.. Please help us!

You can take legal action if your neighbor's redirecting water is causing your problem. Consult with a local attorney.
