Legal Question in Real Estate Law in Georgia

Power Line Easement

I woke this morning to find tree removal contractors in my yard, attempting to enforce a right of easement for the power line adjacent to my property. Without any notification, they were in process of removing a line of pine trees. I asked them to leave and filled out a refusal form, but was told that they'd be back. This line of trees divides my property from the power line, obscuring it (and my neighbor's house) from view. The trees and power line have co-existed for many years and there is no way this species of tree could grow tall enough to interfere with the line. I do not want the trees touched. At the very least, I would like to see the right of easement and make sure that it is enforced to the letter. What are my rights in this circumstance? How can I fight the removal? Am I entitled to compensation?

Re: Power Line Easement

You can fight the removal but the power companies have been doing this for years and usually have all the i's dotted and t's crossed. You could try to get a copy of the easement to see exactly what it says. They will ususally work with you so that a minimum amount of trees are removed.
