What are my rights when dealing with a neglectful HOA? There is a serious drainage problem in the common area between my townhome and my neighbor's home. My townhome's foundation is being threatened by standing water after every single rain. I pay my monthly dues without hesitation, but when broaching a request for action, I am repeatedly ignored. I have attended the annual meeting and raised the issue there. I have emailed the HOA monthly since March 2012.

Is this something that I have the right to just go ahead and fix myself, or could I get in trouble for doing work in the common area? What are other actions that I might take?

Document the problem and write to the Board of Directors demanding that they take action.

If there is a drainage problem in the common area then the HOA has a responsibility to maintain it.
