Legal Question in Real Estate Law in Georgia

Hi I was currently sued by my HOA about 4 months ago I made an agreement to pay an extra 200.00 a month to catch up with what I owed them, I have been making my payments and have proof of all my payments. About 2 weeks ago I was served by my HOA claiming that I had not made any payments, which is not true. I filed an answer with the state clerk and am waiting for a court date. My question is in the meantime do I have to continue making the extra 200.00 a month payment along with my regular hoa fee?

No one here knows any terms of the agreement, and you did not tell us. The lawsuit indicates the HOA may think there was no agreement, or you breached it. As far as the extra money, you still owe it either way, correct? How will it help you to stop paying? You need to contact them and work it out before you get a judgment.

What does your WRITTEN agreement with the HOA to catch up payments say?

If they have broken that agreement, comply with it and file proof in your answer.

If there is no written agreement, then you mispoke and have no agreement with them and should immediately catch up the payments so you are completely current.
