Legal Question in Sexual Harassment in Georgia

College Sexual harassment from my adviser

I have aready filed a formal complaint with my school as has another girl. I attend a technical college. They say they are doing everything they can to take care of this as quickly as possible. They want me to tell them in writing what I want them to do, what I want from my adviser if anything, and if I want any type of compensation. They've offered on campus counseling but I'm not comfortable with that. I need to know what I shouldn't say just yet if I intend to sue. This man got very graphic about things with me and I have not been able to sleep or eat right for weeks... PLEASE, help me! I just don't want to give them something other than my complaint in writing if it will harm me later when or if I decide to sue. If anything I just want to be re-embursed for counseling, and possible the fact that I can't seem to make myself go back to this school... Thank you for your time...

If this man cannot be essentially characterized as your "superior", with some power to decide whether or not you stay in school, gradutate, etc., and if he is not asking sexual favors as a condition to any favorable action, and if this is your first complaint about this person, and if the school has a good faith written sex harassment policy they are dutifully following, any attempt to sue them for this will fail if they follow the policy and take reasonable action under the circumstances to attempt to correct things. Tell them you are going to consult with an attorney to determine what is a reasonable remedy to request here before agreeing to anything. Neither EEOC nor the courts are likely to back you under such circumstances if you do not give them at least a chance to rectify the situation. If the action proves ineffective and the man persists, then, you may be justified to immediately then sue. You should probably get a copy of your school's sex harassment policy as soon as possible and call me for a free initial consultation. I practice in Gainesville, but will take these kinds of cases anywhere in the state if they are meritorious. But, one thing you don't want to do right now is sign any agreement not to sue them.
