Legal Question in Sexual Harassment in Georgia

Sexual Harassment in the Workplace

The wife of my former boss fired me over the telephone because she suspected that I was having an affair with her husband. My boss upheld her firing of me, even though she has no legal standing in the company, as an owner or otherwise, because he was scared she would divorce him. Now I'm out of a job, even though my performance was impeccable and I was very valuable to the company. Is this legal?

Re: Sexual Harassment in the Workplace

If you have a case, it will be based upon more facts than you provided. Perhaps you can seek referrals of qualified harassment lawyers in your area and set up an appointment to review the whole story. Keep in mind your boss fired you, his wife did not, even if she told him to do it. Moreover, your value to the company is not too relevant. What is missing is any actual "harassment" or "hostile work environment" from your boss (not his wife) beyond just getting fired, and whatever backstory that led to it (there usually is a story, even if you do not know what it is). Realistically, if there is an issue between a wife an employee, the wife (or husband) of the employer will naturally prevail and "at will" employment will often allow an employer to terminate an employee just beause the spouse did not like the employee. Again, what is the rest of the story (if there is one), and does it constitute actionable harassment beyond merely getting fired?
