Legal Question in Traffic Law in Georgia

Is There a Code Can I Plead Under to Avoid Points?

I got a Speeding Citation for doing 80 in a 55 on I85 in Georgia.

Is there an OCGA Code that I can Plead Under to Avoid getting Points on My License?

I have an otherwise clean driving record with no citations in the last 7 plus years, & only one other ticket in my life, back in November 1997.

Also, when I was pulled over the State Trooper motioned for me to exit my car (after pulling over on the Interstate), instead of walking up to the car himself.

I was wondering if that was common practice, because to me that seemed to be an unsafe practice?

I had both front windows of my car rolled down, & my windows are not tinted beyond factory tinting & I pulled over as soon as traffic permitted, using turn signals to change lanes, & I placed my car in park & shut off the engine, so he had no reason to believe that I would take off on him or otherwise posed a threat to him.

Thank You in Advance for any assistance anyone can offer.

Your best bet is to ask the solicitor to reduce the amount over to 69 in a 55, whcih they should do if you have a clean record. Even though you will still have to pay a fine, this will prevent any points on your license.

You can plead Nolo Contendere once every 5 years. It is latin for "no contest". It is different than a guilty plea because it allows you to pay the fine and court costs for 25 mph over, yet no points are placed on you license. Regarding your second question, it is not relevant to your case how the officer directed you after pulling you over. If you have further questions feel free to call my office. (404) 529-9081
