Legal Question in Traffic Law in Georgia

So I got a ticket for " NO INSURANCE" 40-6-10 in Georgia at 9:00 a.m. on 8-20-10 The cop wrote me the ticket, let me have my truck towed to my house, which was nice of him.... At 10:00 a.m. I call Allstate and have my truck insured. On my insurance card it says "Effective Date 8-20-10" which of course is the same day of the ticket.

Now, I know I'm in the wrong here. I think my you already know what my question is. When I go to court and show the judge my INS. card with an effective date the same day as the ticket do you think he'll accept it and drop the charge or will he just get pissed & delve deeper into what time the policy actually started. And How can I find out what time it actually started that day? I was told policys start at 12:01 am on the effective date.. Thanks ,

I would tread lightly Joey. The LAST THING you want to do is lie (or give the appearance of lying) to a judge in open Court.

You don't want to end up in jail for perjury, a felony.

Call your agent and have them send you the dec page which should show the start time. If it is retroactive to 12:01 AM (and even if it is not), discuss your options with a lawyer.

Phil and Glen are correct. Bring documents with you to court and show Judge with explanation (tell him that although insurance cards reflects poly started same day as ticket that you do not want to give the court the wrong impression or lie and that you got insurance right AFTER ticket

Maybe, because of you honesty, Judge will suspend sentenc and fine

If you do not tell him and lie, you will be facinf felony perjury charges and Judge will send you right to jail for 20 days and fine you $500.00 for criminal contempt (and thatr's in addition to no insurance and felony perjury charges)
