Traffic accident and liability

I used my girlfriend's car without permission and hit a parked vehicle. My licsence was already suspended. The insurance company will not pay. I was not charged in any way by the police for the accident which happened a month ago. I told the person I would pay for the damages on a monthly basis. She's upset because insurance will not pay. She said she's going to put a criminal warrant out on me. Since I was never charged of any crime in this matter is this criminal case or a civil matter. Thank-You.

Sounds like you could have both a criminal and a civil mattter, but so far, don't have either one. The other driver has the right to sue you civilly, but I don't know why she would bother if you've already told her that you would pay for the damage.

Criminally, the other driver could apply for a warrant hearing. You would be required to appear in court and the court would determine whether there is enough evidence against you to charge you with Driving on the suspended license. However, I don't think the court would find enough evidence though because she would have to show the court evidence that you had a suspended license. If this does happen, you may want a lawyer to go with you.

All in all, we should have little sympathy for her since she should have purchased Uninsured motorist coverage for herself, and may even have it.
