Legal Question in Wills and Trusts in Georgia

Who is in charge?

My aunt has passed away, my cousin is handling everything and taking her time about it. Since the sisters have no clue that they have rights or what to do they are doing nothing.

My aunt has always said everything was to be left to me, but the cousin is the only one with access to anything and won't let anyone in on what she is doing, the cousin has also mentioned selling the house that is supposed to belong to me. How do we find out if there was a written will, who has power of attorney, and how we can go through the house and papers to keep her from taking what might not belong to her?

Re: Who is in charge?

Is the estate in CA of GA? Is the property in CA or GA?

As for CA, you would open a Probate, if one has not already commenced. As a beneficiary, you can Petition the Court for an accounting, a copy of the will, etc.

If CA law is or may be involved, I'd behappy to take a cursory look for you, free of charge. Please contact me, at your earliest convenience, at my office at 626-578-0708, extension 4. You can also reach me through our firm's site at www.No-Probate.com

If your aunt was a resident of GA at the time of her death, you can check with the probate court in that county to see if anything has been filed. If not, you can petition the court to be appointed as administrator of the estate. You should consult with a local attorney, since the process is complicated.
