Legal Question in Wills and Trusts in Georgia

can he contest the will

My Grandmother passed away in September. She left everything to my mother. The man she was married to has said he was going to contest her will. They were not living together because he threw her out of his house the end of July. She was legally living with my mother. He wants all her stuff and her kids to have nothing. Can he contest her will? They were only married for three years.

Re: can he contest the will

Of course he can always contest the will. Whether he will be successful is another matter. You should consult your attorney on this question because a very detailed analysis of the facts at the time of the execution of the will needs to be done. It does not matter how long they were married. It does matter whether the will was made before or after their marriage. If before, there may be some serious problems.
