Once a person dies can you get a copy of the will from Probate Court before it is probated.

Maybe. Some people (but very few) file their Wills for safekeeping with the Probate Court before they die. If the petition to probate has already been filed, there should be a copy in the court's file. If not, what you can do is to file for an administration of the estate and subpoena whomever you think has the original will. Consult with a local attorney.
