Legal Question in Wills and Trusts in Georgia

Estate Adminstartor

Following the deaths of my parents, my brother filed to be administrator of the estates, there are 8 living hiers. We all signed giving him permisssion - after he became administrator he borrowed money against the family home in which I live to make repairs however he used the money to start a buiness and I recieved on 20000.00 from a 60000.00 loan. According to him all the property from my parents estate is in his name and I am wondering how that can be when we only signed to give him permission to be administrator of the estates. If he doesn't repay the loan could I loose my home even if he did something illegal to get the properties in his name?

Re: Estate Adminstartor

You brother could be in serious trouble. The administrator is not allowed to treat estate money as his own. You should consult with a local attorney with an eye toward having him be removed as administrator or at least filing a motion requiring him to file an accounting with your local probate court to explain his actions.
