Legal Question in Wills and Trusts in Georgia

Estate probate

My father died on January 15 and I am his only living child. I went through probate and received administrator rights from the court.

There was no will. I have gotten my name on his home title in order to sell it. My stepsister not my fathers

child and never adopted has called the real estate broker and told them I do not have the right to sell the house as she should get a portion of the profit. Probate said she did not have any right , however i need to hear that from a legal attorney.

Re: Estate probate

Based on what you have stated, it certainly appears that she has no rights in the property or the proceeds. However, before I could give you a firm opinion, I would need to review the Probate Court documents and discuss the entire matter with you. If you would like to discuss, please feel free to call me.

As a real estate attorney, I would know if you have the doucments that are required for an attorney to conduct a lawful closing or not, if I had access to them. This determination may also involve a title search. If you wish to employ a firm to assist you, please do not hesitate to contact me.
