Legal Question in Wills and Trusts in Georgia

Farm inheritance

My father has structured his will to divide his farm among his 4 children, with the stipulation that the land cannot be sold outside the 4 of us. I don't see a problem yet, but the day may come when one wants to sell and the others may not have the money to buy. How does this work? Can this stipulation be enforced?

Re: Farm inheritance

It is an illegal restraint on alienation and cannot be enforced. You will need a title company that understands this concept.
