Legal Question in Wills and Trusts in Georgia

Georgia

Father has cancer, properly executes a quitclaim deed for his house and property to his 35 year old daughter. No leins on the house nor property. 5 months later father passes away. Has no will. Large medical bills start arriving. Is there a look back period for the quitclaim deed? Is the house and property safe from the medical creditors? Any creditors?

You did not provide enough information in order for your question to be answered. You should re-submit the question indicating how your father's health expenses were being paid for (e.g. Medicaid, Medicare), or better yet, consult privately with an attorney in the state where your father resided/received medical care.

Re: Georgia

What you have described may be called a fraudulent conveyance. One cannot simply give away property to relatives to shield them from debts, even though that may not be the primary reason. Creditors may sue both parties if this is the case.
