My husband is wanting to file suit over his Moms estate. He needs to know if he files in the county the will was probated or in the county of the person he's filing against.We live in Georgia.

No one here knows the basis of the suit, the standing of you husband, whether he is suing on behalf of the estate, himself, or someone else, and many other facts. Obviously, he needs a lawyer either way. The lawyer, who should be experienced in these matters, will know how to proceed.

Whoa! Before your husband files a lawsuit, he really needs to consult with a local attorney. It may be that he can just file a claim in the existing probate court case where the will was probated.
