My mother passed away recently. At the time of her death there was a civil lawsuit pending against her via her car insurance company. The suit had been filed in VA but she had not been served as of yet at the time of her death in GA-where she resided. When she passed she did not have a will but the family has paid her debts off. We have a house to sell and that is the only asset she really had. Other than incidentals like furniture, etc.. How will the civil lawsuit effect her estate? The defendant is suing over the limits of her car insurance policy. Can the house still be sold? Will the lawsuit hold up the dispersal of her estate? Thank you.

Surely the lawyer you hired to handle the probate has advised you on this. (If not, you need a better lawyer, as this is critical). The estate needs in all likelihood to defend the suit, and nothing should be done until the suit is resolved. Since she left no will the estate needs an Amninstrator. Heirs will likely have to wait on the suit.
