Legal Question in Wills and Trusts in Georgia

Problems with Administrator and Attorney

How do I file for an accounting of an estate? My father passed away (intestate) in GA and I live in California. My brother, who lives in Georgia, has been appointed Administrator. He was appointed in May 2006 and has done nothing since that time. My brother, and the attorney we hired to handle the probate, have ignored my calls, and have refused to speak to me. The only paper work I have received was sent to me by the Effingham County Probate court. My address is listed as unknown, even though I have given it to the court, the attorney and my brother. The attorney also listed the value of my fathers estate at $35,000, which is well below the actual value since, in addition to personal property (including several vehicles and a boat) checking, savings, and retirement accounts my father owned a home in GA and an acre of property on Daufuskie Island, South Carolina. I didnt think I needed an attorney since we hired one to to handle the Probate of my fathers estate. However, now I think I should. Any suggestions?

Finally, if I am unable to find an attorney, what do I need to do to have the administrator removed? Do I need to use a specific form? I look forward to hearing from you. Thank you.

Re: Problems with Administrator and Attorney

You should locate an attorney who practices probate law in the county seat (Rincon), or in the nearest large town (Savannah). Contact the local bar associations for Effingham and Savannah, GA for attorney referrals.

Hire an attorney in Georgia to pull the file and check it out first. Then discuss what he finds and what action he recommends.
