Legal Question in Wills and Trusts in Georgia

Receipt for items received from a Will

I would like to know if there is a Legal form that will show that the persons signing has received or refused receipt of property left to them in the Will? I would also like to know if you have to take the Will before a probate Judge after the person has died or if you can handle it on your own, with everyone agreeing?.

Re: Receipt for items received from a Will

Your post implies that you expect a dispute with heirs. In that case, definitely get a lawyer.

The will must be filed with the probate court. If there are assets for distribution, nothing can happen until the will is admitted for probate. In some cases heirs may be able to reach agreements as to some things; again that requires a lawyer.

There is no receipt "form" and again, if there are goingt o be questions in this area, a lawyer is needed.

If you're in the Atlanta area, feel free to contact my office if you need a lawyer. In many probates you can do much of the legwork and that will minimize the needed lawyer work, and keep fees low. Our number is 404-768-3509.
