wrongful death claim

my father was killed in a car accident. a man crossed the center lane and hit him head on at 80 mph. the other man died at the scene. my father died a few hours later at the hospital. he had no will or no life insurance. my stepmom hired an attorny and a wrongful death claim was filed against the other mans insurance, farm bureau ins agency. her lawyer stated that my stepmon, me, and my sister was an heir and that we were entitled to 1/3 of his estate. my stepmom claims she settled for $100,000. it was to be split 50/50, half to her for loss of his income and the other to the estate. the attorney fees were to be split between the two halfs. $16,500 from the estate and $16,500 from her. that leaves $33,500 in the estate. his hospital bills were to be paid out of the estate which exceeded the remaining amount, leaving nothing to me or my sister. my stepmom also recieved $48,000 from his employer for double a years salary. was this to her or to the estate? is all of this shes telling me true and what are my liabilities as an heir to anything he might have owed or any other expences.
