Back injury at work

My husband suffered from 2 disc herniations on the job L4-L5 and L5-S1. He had surgery 3mths ago. He went for his 3mth check up and the dr. ordered PT for 4 wks then FCE. He also stated my husband can return to work after the FCE and according to the FCE. My husband is 25 yrs old. WC wanted to talk settlement but he said no w/o hearing a figure b/c he knew there was more med that needed to be done. However, once the FCE is done, he thinks he may be ready. We are concerned that being my husband's age, he may have to have another surgery in the future, the surgery this time cost $146,000 - not including the time off of work, pt, meds, or follow up visits. Will wc take this into consideration in the settlement or will they just pay a very little? He has been out of work since his injury and the dr. told him he can not do ''blue collar'' work again (which that is all he has ever done and knows). My husband would like to settle but is there a ball park figure that he may be looking at to give us an idea? He had a decompression and fusion, his wkly pay from wc now is $360, it has been 11mths since his accident. Is there a difference in the settlement if the dr. releases my husband for work before he settles vs. after? Thank you very much

Given the severity of your husband's injury and surgery, including his work restrictions, I would not settle this case for any less than a six figure range. It could be worth alot more and he would be entitled to a second opinion regarding his future medical needs etc... The insurance company will not tell you about that or many of your other rights.
