Legal Question in Workers Comp in Georgia

For Which Impairment Should I Be Paid?

I recently received PPI ratings from my doctor resulting from an on-the-job injury. He rated me 52% impaired little finger, which is 10% impaired hand, which is 9% impaired upper extremity (meaning arm?) The 9% upper extremity impairment pays the most weeks of PPI benefits. Am I entitled to payment for this impairment or can the insurance company choose which impairment to pay me for?

Re: For Which Impairment Should I Be Paid?

It is frequently the case that the treating physician or the physician assigned to evaluate the impairment rating will give alternative or equivalent ratings. The board will use the rating which is of the most advantage to the claimant. That is the point of beginning in evaluating your claim for settlement purposes. Because of the complexity of setting a proper value to your claim for settlement purposes, I strongly urge you to have your claim reviewed and evaluated by an attorney who practices in the area of worker's compensation. Issues such as close out of your claim, resignation from your position, future medical, and the like all need to be considered and a part of a proper evaluation of a claim for settlement purposes. If you wish I will be happy to discuss the process on a no obligation basis and if I accept your case it will be on the basis of a contingency fee based on the value of the settlement and subject to approval by the State Board of Worker's Compensation.
