The law is protecting criminals!

Husband was injured at work and employer had no WC. Court ruled in husband's favor and is receiving weekly (below minimum wage) checks. Now they are denying PT and mental health counseling as ordered by dr. Why these people have any rights at all is beyond me! We are looking for new aggressive attorney but this is difficult because most won't take case because GA will not allow us to sue and they never have to settle. Husband is looking at 2 surgeries. We are financially ruined but the crooks are making $ and adding to their property. How do you change this law that protects the unlawful? Its been 1 1/2 years!

Your factual statement provides insufficient information from which to truly respond to your frustration and situation. Generally, issues regarding treatment have to be resolved by the board if the parties are unable to agree. There are sometimes issues regarding necessary and approrpriate treatment which result in impasse which only the board can resolve. There are some criminal penalties for failure to have insurance or qualify as a self insurer. There are also other penalties which the board can impose of a financial nature. The real issue is your husband's health, and insuring that he has his medical needs met to get him back to gainful employment if that is possible. Worker's compensation is a special area of the law and the limitations you have run into are sometimes frustrating, but that should not prevent you from securing the treatment necessary if the company is viable and has assets from which to pay for the treatment the boad has ordered.
