Legal Question in Workers Comp in Georgia

Do I need a lawyer?

I had a knee injury last year and arthroscopic surgery in Jan. of this year. I've been on a leave of absence since the surgery

and I have received workman's comp and all the medical treatment I've needed so far. The job wants me back with no restrictions so the doctor has been keeping me out of work, but

now they are setting me up for the fce and pdd tests and I am wondering do I really need a lawyer for whatever happens next.

The doctor states that my knee has severe damage to it but I can walk ok so far.

Re: Do I need a lawyer?

You might need a lawyer if the insurance company tries to send you back to work before you are ready, or sends you to one of their doctors who gives you a lower PPD (permanent partial disability) rating than you should get. There are other things they can do to manipulate your case. We handle workers' comp. cases all over the State of Georgia and would be glad to talk to you about it. Give me a call at 404.352.3400.

Re: Do I need a lawyer?

There are several things that could negatively affect the future of your workers' compensation case. The facility administering your FCE and PPD may not provide accurate results. As a result, your employer may try to force you back to work in a position that is outside of your physical limitations, which could lead to further injury and/or suspension of your benefits. You have a right to an independent medical evaluation and this may be the time to utilize that second opinion to ensure that there is nothing more than can be done for your knee or to refute the FCE or PPD results. Keep in mind that you should consult with an attorney before agreeing to anything that makes you uneasy or before agreeing to something that may have a negative effect on your claim. Workers' compensation attorneys in Georgia do not charge hourly fees; therefore, you should not have to pay a consultation fee or a retainer if you decide to hire an attorney after meeting with one. Good luck and feel free to call me if you have any further questions.
