How much is enough for a worker's compensation settlement?

My husband fell off a 12-foot scaffolding back in September, 2001. He severly broke his ankle and had to have surgery to insert a plate and screws. The insurance company paid him weekly pay checks in the amount of $335.00 for 7 1/2 months. He went through physical therapy and another surgery to remove the plate and screws due to infection. He was not fully released to go back to work until April, 2002. The doctor rated him based on his movement of his ankle. He was rated 2, 5 and 7 out of 10. The insurance company contacted him last evening with a settlement of $7000.00. We have no idea if this is even acceptable. I just know that my husband's ankle is never going to be 100% for the rest of his life. Should we ask for more and what reason's should we give ? Please respond. Thank You.

Thank you for your question. I appologize for taking so long to get back to you. What the authorized treating physician has done is give your husband a Permanant Partial Disability rating. This dis. rating corresponds to a dollar figure. I am unsure from you messege what percentage your husband's PPD rating was, however, if you feel that the PPD rating is too low you have the right within 60 days to request an Independant Medical Examination that may give your husband a higher rating.

Another point you should know is that the PPD rating is not all your husband may be entitled to. If there is a possibility that your husband will need further medical treatment in the future you may demand a lump sum settlement for that future medical treatment and lost wages if there is a chance that he will be out of work in the future due to his work related accident.
