Legal Question in Family Law in Guam

i have been living on guam with my ex boyfriend and his parents for over a year & that whole year we have not been together, we have two kids a 2yr old and a 1 month old. i do not have any close family here on guam and wish to go to the states with my kids for a better life.my parents and family live in the states. he has not agreed to us leaving. will i get into trouble if i take my kids and just leave ? is there any way to avoid taking this to court ?

In general, if there is a court ordered custody agreement regarding the kids, a violation of that order could result in problems for you, both criminal and civil. If there is no court order regarding custody, you could leave island with your kids. If you do that you should immediately file for custody in the state that you go to. You should also obtain some type of identification for the children if you leave so there is no question regarding your being a parent. A passport would be best although an original birth certificate could also do.
