My lease was never delivered

I started a new business in April '01. When I found a commercial space, I put a deposit down and was promised, in writing, that a lease would be coming. 10 months later I still don't have a lease. What are my rights???

A lease is a mixture between a Contract and an Interest in Real Property. From what I can grasp from your short question -- generally, the writing you possess is probably only an agreement to agree and not a full fledged Contract because there is no mutual assent and full negotiations regarding all the clauses that would be in a Commercial Lease never took place. Unless you negotiated for an option - meaning you paid for the right to lease the premises -- Are there terms I don't know about? Why did you wait 10 months? Did you try to get your deposit back?
