performance contract

my lawer assures my [in front of a witness] that the courts 'cannot make me perform'' to build a home that was under contract. Is this true?

Probably, unless your contact still requires you to perform. But generally the courts to not want to force someone to perform a service because there is little way to ensure that the service will be done well.
