Legal Question in Consumer Law in Hawaii

Hi, I recently purchased a new car. The dealership has since called me to say I now need a co-signer to keep the car. While I was at the dealership they asked me multiple times if I could get a co-signer. I explained to them that I did not want to ask anyone for help and if need be I would buy a cheaper car or keep the one I had for the time being. They then talked me into higher monthly payments saying that would be the only way I would be able to purchase the car on my own. I agreed and gave them the title to my car at the time and posession of it as part of the trade in. I left with the new vehicle that day. When I looked at the contract today,I saw a side bar "seller's right to cancel" that I signed. Do I legally have to turn this car back to them?

Hello,

Sorry to hear about your ordeal. Unfortunately, you probably signed a contract that said that the dealer could rescind the deal if they later found out that they could not qualify you. The sale is sometimes conditional in that sense. Its not fair and in my opinion deceptive. I have considered suing the dealers for this type of unfair practice. They shouldn't be allowed to take your trade-in and let you leave with the car until they get final approval.
