Legal Question in Family Law in Hawaii

My wife may have ''hidden'' money anticipating divorce!

I am in the process of a ''uncontested'' divorce. I have discovered a joint account that has been ''cleaned out'' by my wife on 05/28/2003, (on this same date she closed out our existing joint checking, savings and VISA accounts, of which I was not informed until I tried to use them) with no prior notice to me. Indeed, I only discovered this in the process of completing a required ''assets and debts'' form for the court proceedings. I am not certain where or how to proceed with this information. I have been suspect of the possibility of a much greater amount being hidden by her in the recent past, as the $40,000 in cash we received from a refinancing of our home in 2002 was ''gone'' in five months time. I had entrusted her with all the financial responsibility, so is this legal? Do I have any recorse? How can I search for hidden funds?

At this point, you probably must go through a "contested" divorce. During a contested divorce you may subpoena the bank records to show her financial indiscretions. If that is the course you wish to take, feel free to call us at 1-808-526-0892.
