Legal Question in Traffic Law in Hawaii

Dui ?

Why am I being charged with operating a vehicle under the influence of an intoxicant if I blew under the legal limit at the station which was .59. officers informed me that I'd only have to appear in court for driving without a license. I showed up with proof of license at court and before I could speak I was rescheduled to reappear in court with a lawyer. I was handed the case papers which included operating a vehicle while under the influence of alcohol in an amount sufficient enough to impair her normal mental faculties or ability to care for herself and guard against casualty, thereby commiting the offense of operating a vehicle under the influence of an intoxicant in violation of section291E-61(a)(1) of the hawaii revised statutes. --name removed--how could this be, if I was reassured at the station by officers that it's not a dui I was just being booked for driving without a license?

Your case sounds very unusual. You should get either a public defender or private lawyer to represent you for the next appearance. If you are under age 21, there is a 0 tolerance dui law with cut off at .02. If you have more questions, call or e-mail me.
