Legal Question in DUI Law in Idaho

Officer injured me

I was recently arrested for DUI and I took the sobriety tests. The officer then told me he was placing me under arrest and when I asked him which test I failed he would not tell me, I asked again and then he threw me against my car and injured my arm, is this legal for him to do? My arm is all bruised, and I do have a witness for this.

No this isn't right. However, he may have felt that you weren't cooperating with him and dealing with intoxicated people on a regular basis, if you aren't doing as the officer directs they sometimes get carried away. this doesn't excuse the behavior it may explain it a little. Anyway, you can contact his commander and report the abuse. Did you go to the doctor to have him documents that you were injured? You should have to have evidenc to present. You can also sue the county and the officer for exceeding the bounds of propriety and committing a battery against you anc causing injury.
