Legal Question in Family Law in Idaho

support payments when child goes to college

My stepdaughter will leave for college in the fall. The divorce decree, signed 13 years ago, states that we are to pay child support until the age of 19 if she attends college. My question is: can we change where the money is going for that final year? Legally she is considered an adult. She will not be living with her mother, therefore her mother will not be providing her with food, shelter or clothing. We don't have a problem paying the money, we just want to make sure it gets to my stepdaughter - which will not happen if the state is sending checks to my husband's ex wife. thanks.

Re: support payments when child goes to college

I'm assuming from your question that you are currently paying the support payment to the Dept of Health and Welfare and not directly to the ex wife. I would recommend contacting the Department as soon as you know where your stepdaughter will be living. If the Department won't transfer the funds to the daughter, it may be worthwhile to employ a child custody mediator to reach an agreement with the mother regarding how the payments will be used for the daughter's benefit.
