U.S. Femal Citizen marrying a Mexican National in Mexico

After marrying a Mexican national in Mexico and returning to the U.S. to work before retiring to Mexico, does my Mexican husband have any legal rights here in the states? For instance, can he be named beneficiary on my pension and life insurance plans? I do plan to live full time in Mexico once I retire in 2 years.

Dear Inquirer:

Your question is more of an insurance and retirement benefits law question than an immigration law question. Unless you petition your husband, he will have no immigration status in the US by virtue of the marriage alone. He most likely may be designated as the beneficiary of your retirement and life insurance accounts, however, unless there are some terms within the policy or retirement plan that prohibit the designation of non-resident beneficiaries.
