Legal Question in Workers Comp in Idaho

Why will no attorney consider taking my case?

Several weeks ago while at work, the chemical company that delivers the cleaning solutions

we use, delivered a bad batch of acids that began out gassing. They decided that it was a better idea to pump the chemicals into our storage tank than to risk the wrath of the haz. mat. teams that ply the freeway in Idaho. The air handler sucked the fumes(they were bright yellow) into the plant. I and many others were exposed to nitric acid fumes. My office is next to the air handling duct work and it blows directly into it the office. My question is why can I not find an attorney that will take this case seriously?

PS I have been to the doctor several times and have been diagnosted with chemically induced pnuemonia.

Re: Why will no attorney consider taking my case?

I am an attorney in Illinois. But the answer to your question may lie in the laws of the laws of your state. In most states, one must prove a premanent injury in order to collect compensation, the part we call permanent partial disability. This is the area from which attorneys generally collect their fees. If you are not likely to be left with some permanent injury then lawyers would not be interested. They do expect to get paid for their efforts and are entitled to be compensated too. However, you have what we call and occupational disease. Your state may not allow as much for such injuries as Illinois does. Also, there is a conservative trend in the law against individuals. You should be conscious of this when you vote for your state representatives and your governor. The laws being enacted in many states are NOT employee friendly. Many times this situation only becomes apparent to the voter when he is in need of his benefits. Therefore, you should determine the positions of your candidates before you decide who to vote for. The entire country needs more employee freindly representatives. Good Luck.
