Legal Question in Family Law in Illinois

moving out of house during proceedings

If the wife wants to move out of the home during the divorce proceedings, will this adversely affect her portion of the proceeds from the sale of the home? She is experiencing severe mental and verbal abuse on a daily basis. She is also concerned with the well-being of the two children since the husband has begun to drink daily. Besides seeking an order to remove him from the home, the wife leaving with the kids seems to be the best option.

Re: moving out of house during proceedings

Moving out of the house should have no adverse effect. It might even help her cause, showing not only the problems she is having with her husband, but also establish her future monthly expenditures, which may help determine the maintenance, child support, and division of the marital estate.
